Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") form a binding agreement between you and HomeDash LLC ("HomeDash," "we," "us"). By accessing or using homedashawaydash.org or any HomeDash service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. The HomeDash marketplace

HomeDash operates an online marketplace that connects customers seeking home services with independent third-party professionals ("Pros") who provide those services. HomeDash itself does not perform home services. We are not a party to the agreement for services between you and a Pro, except as expressly stated in these Terms or the Happiness Guarantee.

3. Accounts & eligibility

You must be at least 18 years old and able to form a binding contract to use our services. You agree to provide accurate information, keep your account credentials secure, and accept responsibility for all activity under your account. Notify us promptly of any unauthorized use.

5. Cancellations & refunds

You may cancel or reschedule a booking through your account. Cancellations made at least 24 hours before the scheduled start are free of charge. Late cancellations or no-shows may be subject to a fee to compensate the Pro for reserved time. Refund eligibility is described at the time of booking and is also governed by Section 6.

6. Happiness Guarantee

If you are not satisfied with a completed job, contact us within 72 hours of completion. We will work with you and the Pro to correct the issue, arrange a re-service, or, where appropriate, provide a refund, subject to reasonable review. This guarantee does not cover pre-existing conditions, requests outside the agreed scope, or damage caused by the customer.

7. User conduct

You agree not to misuse the platform, including by: providing false information; harassing or discriminating against Pros or staff; attempting to arrange or pay for services outside the platform to avoid fees; interfering with the operation or security of the site; or using the services for any unlawful purpose.

8. Independent professionals

Pros are independent contractors and are not employees or agents of HomeDash. HomeDash screens Pros through identity verification and background checks and verifies licensing where required, but does not guarantee the outcome of any particular job. You are responsible for providing safe access to your property and for securing valuables.

9. Intellectual property

The HomeDash name, logo, website, and all related content are owned by HomeDash LLC and protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission. You retain ownership of content you submit but grant us a license to use it to operate and improve the services.

10. Disclaimers & limitation of liability

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, HomeDash will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total aggregate liability arising from or related to the services will not exceed the greater of the amount you paid for the booking giving rise to the claim or one hundred U.S. dollars (US $100).

11. Governing law & disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the services will be resolved in the state or federal courts located in Bexar County, Texas, and you consent to their jurisdiction. Where permitted, the parties agree to first attempt to resolve disputes informally by contacting one another.
